This page explains the terms, policies, disclosures, and conditions that apply to your use of Viral-Accelerator.com and the Viral Accelerator program.
Viral Accelerator is owned and operated by Higher Level Strategies, Inc., a Florida corporation (“HLS,” “Company,” “we,” “us,” or “our”).
By accessing this website, creating an account, purchasing Viral Accelerator, participating as an affiliate, or using any products, services, funnels, training, software, traffic, or other resources provided through this website, you acknowledge that you have read and agree to the applicable terms on this page.
If you do not agree with these terms, please do not purchase or use our services.
TERMS OF USE
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or participate in Viral Accelerator.
Viral Accelerator is a digital marketing product and done-for-you service intended to provide customers with marketing infrastructure, tools, training, and resources. Nothing provided through Viral Accelerator constitutes legal, financial, tax, investment, or accounting advice.
You are responsible for how you use the websites, funnels, marketing materials, training, traffic, affiliate links, email messages, software, and other resources we provide.
You agree not to use Viral Accelerator for unlawful, fraudulent, deceptive, abusive, or misleading activities.
We may modify, improve, replace, discontinue, or update portions of the website, software, funnels, training, resources, or services when reasonably necessary to operate and improve the program.
WHAT VIRAL ACCELERATOR PROVIDES
We build a marketing funnel for you. Viral Accelerator is a done-for-you marketing funnel service designed to help customers build an online audience, capture leads, follow up with prospects, and promote offers through a structured marketing process.
Depending upon the package or promotion purchased, services may include funnel pages, lead-capture pages, bridge pages, bonus pages, sales or offer pages, email follow-up content, affiliate integration, tracking, training, traffic, promotional resources, or other services specifically described on the applicable sales page.
The exact deliverables included with your purchase are those stated on the sales or order page at the time of purchase.
Viral Accelerator does not operate your business for you. We provide infrastructure, tools, resources, and services. You remain responsible for your business decisions, marketing activities, communications, compliance, and results.
CUSTOMER RESPONSIBILITIES
Some Viral Accelerator services require information, accounts, approvals, content, photographs, recordings, autoresponder information, or other materials from the customer.
You are responsible for providing requested information accurately and in a timely manner.
Any stated fulfillment period begins only after we have received the materials reasonably necessary to begin fulfillment. Our current standard fulfillment target is approximately 10 business days after all required customer materials have been received, unless otherwise stated for a particular promotion.
If required materials are delayed by the customer for more than seven days, completion may be scheduled according to our then-current production volume.
Production schedules are estimates and not guarantees of an exact completion date.
THIRD-PARTY SERVICES
Viral Accelerator may integrate with or rely upon third-party platforms and services, including autoresponders, payment processors, hosting providers, video platforms, traffic providers, social networks, analytics services, and other technology providers.
These third-party companies operate independently from Higher Level Strategies, Inc. Their availability, policies, pricing, deliverability, functionality, and technical performance are outside our direct control.
We are not responsible for interruptions, account restrictions, policy changes, outages, deliverability issues, or other actions taken by third-party providers.
Customers are responsible for maintaining any third-party accounts required for their particular implementation.
TRAFFIC DISCLOSURE
Some Viral Accelerator packages or promotions include an initial traffic allocation.
When traffic is specifically included with your purchase, we will arrange for the quantity and type of traffic described in the applicable offer. Unless expressly stated otherwise in writing, traffic represents visits or clicks, not guaranteed leads, subscribers, customers, or sales.
Traffic is intended to provide an initial source of visitors and a starting point for the customer's marketing efforts. It is not a promise of continuing traffic or a replacement for the customer's own marketing activities.
We do not guarantee the actions visitors will take after arriving at a page.
NO GUARANTEE OF RESULTS
Purchasing Viral Accelerator does not guarantee that you will generate leads, sales, commissions, profits, or any particular business result.
Internet marketing involves numerous variables outside our control, including the quality and source of traffic, market conditions, the offers being promoted, pricing, messaging, customer behavior, competition, email deliverability, advertising platforms, customer effort, and other factors.
We provide tools, infrastructure, education, marketing resources, and services. We do not sell guaranteed income or guaranteed business results.
EARNINGS DISCLAIMER
Viral Accelerator is designed to assist customers with online and affiliate marketing, but there is no guarantee that you will earn money by purchasing or using Viral Accelerator.
Any examples of commissions, revenue, sales, leads, conversion rates, business growth, or other results shown in our presentations, websites, emails, training, testimonials, case studies, or promotional materials are provided only in the context in which they are specifically presented.
Individual results vary substantially.
Past performance by Higher Level Strategies, its owners, customers, affiliates, students, partners, or testimonial providers does not guarantee or predict your results.
Your results depend upon many factors, including your experience, effort, marketing activity, audience, traffic sources, offer selection, market conditions, expenses, and business decisions.
You should never purchase Viral Accelerator based upon an assumption that you will recover the purchase price or achieve any particular level of income.
TESTIMONIALS AND EXAMPLES
Testimonials and customer stories represent the experiences and opinions of the individuals providing them.
Unless we specifically state otherwise, they should not be interpreted as a representation of what every customer will achieve.
Where a person providing an endorsement, testimonial, presentation, bonus, or promotion has a financial, affiliate, business, or other material relationship with Higher Level Strategies, that relationship should be disclosed where required by applicable law.
We do not authorize affiliates or customers to fabricate testimonials, results, income claims, or experiences.
AFFILIATE PROGRAM
Viral Accelerator may allow approved customers or other approved individuals to promote Viral Accelerator as affiliates.
Affiliate commissions are compensation for qualified referrals and are subject to the commission structure, qualification requirements, verification procedures, payment schedules, and other program rules in effect for the applicable offer.
Affiliate status does not create an employment relationship, partnership, joint venture, franchise, agency relationship, or authority to legally bind Higher Level Strategies, Inc.
Affiliates operate independently and are responsible for their own marketing activities and compliance with applicable laws.
Affiliates may not make false, deceptive, misleading, or unsubstantiated statements regarding Viral Accelerator, Higher Level Strategies, its owners, its products, potential earnings, or expected results.
Affiliates may not represent that income is guaranteed or imply that purchasing Viral Accelerator will automatically produce leads, sales, commissions, profits, or any particular financial result.
Affiliates must clearly disclose when they may receive compensation from purchases made through their promotional links where required by applicable law.
ANTI-SPAM & RESPONSIBLE MARKETING POLICY
We do not authorize the use of Viral Accelerator for spam, deceptive advertising, unlawful unsolicited messaging, or other abusive marketing practices.
Customers and affiliates are responsible for complying with applicable advertising, privacy, email marketing, and anti-spam laws and regulations in the jurisdictions in which they operate.
This includes, where applicable, requirements relating to commercial email, truthful advertising, identification of promotional communications, unsubscribe mechanisms, affiliate disclosures, and consent.
Accounts or affiliate privileges may be suspended or terminated when we reasonably determine that Viral Accelerator is being used for spam, fraud, deceptive marketing, or other conduct that could harm consumers, our company, our customers, our affiliates, or the reputation of the Viral Accelerator program.
REFUND & CANCELLATION POLICY
Viral Accelerator purchases are non-refundable once purchased, except where otherwise required by applicable law.
Viral Accelerator includes customized digital fulfillment and services that may begin shortly after purchase. This may include account creation, affiliate configuration, funnel provisioning, page creation, customization, copy preparation, technical setup, integrations, traffic arrangements, and staff production time.
Because resources and labor are committed to fulfillment, customers should review the offer carefully and ask any questions they may have before purchasing.
Failure to provide information or materials required for fulfillment does not automatically create a right to a refund.
This policy does not limit any non-waivable rights you may have under applicable law.
INTELLECTUAL PROPERTY
The Viral Accelerator website, software, funnel architecture, templates, training, videos, written materials, graphics, branding, code, documentation, and other proprietary materials are owned by or licensed to Higher Level Strategies, Inc. unless otherwise indicated.
Your purchase grants you the right to use the materials and services provided to you for their intended business purpose. It does not transfer ownership of our underlying software, systems, templates, intellectual property, or proprietary technology.
You may not reproduce, resell, distribute, reverse engineer, sublicense, copy, or commercially exploit our proprietary materials except where we have expressly authorized such use.
ACCEPTABLE USE
You may not use Viral Accelerator to promote illegal products or activities, impersonate another person, infringe intellectual property rights, distribute malware, collect information unlawfully, engage in fraud, manipulate tracking or commissions, interfere with our systems, or deliberately damage the Company, its customers, affiliates, partners, or service providers.
We reserve the right to restrict or terminate access when we reasonably believe a user is engaging in fraudulent, abusive, illegal, or materially harmful conduct.
PRIVACY POLICY
We collect information reasonably necessary to operate Viral Accelerator, fulfill purchases, provide customer support, maintain accounts, administer affiliate relationships, process transactions, improve our services, prevent fraud, and comply with legal obligations.
Information we collect may include your name, email address, telephone number, account information, IP address, device and browser information, affiliate and referral information, page activity, support communications, and information voluntarily submitted during the Viral Accelerator fulfillment process.
We do not sell your personal information as a standalone commercial product.
We may share information with service providers when reasonably necessary to operate our business, process payments, deliver services, provide technical infrastructure, prevent fraud, comply with legal obligations, or protect our legal rights.
Payment information may be processed by third-party payment processors. We generally do not directly store complete payment-card information handled by those processors.
CUSTOMER-SUBMITTED CONTENT
As part of fulfillment, you may provide photographs, recordings, biographies, names, social-media information, testimonials, business information, or other content.
You represent that you have the legal right to provide and use the materials you submit.
You grant Higher Level Strategies, Inc. permission to process, reproduce, resize, edit, encode, host, and display submitted materials to the extent reasonably necessary to provide the Viral Accelerator services you requested.
Submitting content for your funnel does not transfer ownership of that content to Higher Level Strategies, Inc.
Any separate permission to use your image, likeness, testimonial, or results in Company advertising will be governed by the consent provided for that particular use.
COOKIES & TRACKING
Viral-Accelerator.com uses cookies and similar technologies necessary to operate accounts, maintain login sessions, remember preferences, attribute referrals, track funnel activity, analyze website usage, improve performance, prevent fraud, and provide functionality.
Some cookies may be provided by third-party services integrated into the website.
You may restrict cookies through your browser or device settings, although disabling certain cookies may prevent portions of the website from functioning properly.
AFFILIATE & REFERRAL TRACKING
Viral Accelerator uses referral and tracking technologies to identify affiliate referrals, attribute purchases, measure page activity, and administer commissions.
When you follow an affiliate link, information may be stored in a cookie, URL parameter, database record, or similar technology so that the appropriate affiliate can receive credit if a qualifying transaction occurs.
EMBEDDED CONTENT & EXTERNAL WEBSITES
Our pages may contain embedded videos, images, applications, forms, or other content supplied by third parties.
Embedded content may function as though you visited the third-party provider directly. Those providers may collect information, use cookies, or track interactions according to their own policies.
Our website may also link to websites we do not own or control. Higher Level Strategies, Inc. is not responsible for the content, availability, security, privacy practices, products, or services of independent third-party websites.
DATA RETENTION
We retain information for as long as reasonably necessary to operate accounts, provide purchased services, maintain transaction and affiliate records, resolve disputes, prevent fraud, enforce agreements, and satisfy legal, tax, accounting, and regulatory obligations.
Retention periods may differ depending upon the type of information and the reason it was collected.
PRIVACY RIGHTS
Depending upon where you live, applicable privacy laws may provide rights concerning your personal information, including rights to request access, correction, deletion, or information concerning how certain data is processed.
Some information may need to be retained despite a deletion request when necessary for legal, security, fraud-prevention, accounting, contractual, or other legitimate purposes permitted by law.
Privacy requests may be submitted through our support system.
INTERNATIONAL USERS
Viral Accelerator is operated by a United States company.
Customers accessing the Service from outside the United States are responsible for complying with laws applicable to their own activities and jurisdiction.
Where applicable privacy laws provide additional rights, including rights under the European Union or United Kingdom data protection frameworks, we will process valid requests as required by applicable law.
SERVICE AVAILABILITY
We work to maintain reliable access to Viral Accelerator but do not guarantee uninterrupted or error-free operation.
Websites, hosting systems, payment processors, email providers, APIs, autoresponders, plugins, browsers, Internet infrastructure, and other technologies occasionally experience interruptions or changes.
Temporary technical problems do not constitute a failure to provide the Service when we are reasonably working to restore or provide the affected functionality.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Higher Level Strategies, Inc. and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of Viral Accelerator, including lost profits, lost revenue, lost business opportunities, loss of data, or business interruption.
To the fullest extent permitted by applicable law, our aggregate liability arising from a claim relating to your purchase or use of Viral Accelerator will not exceed the amount you actually paid to Higher Level Strategies, Inc. for the specific Viral Accelerator product or service giving rise to the claim.
Nothing in these terms excludes liability that cannot legally be excluded or limited.
INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Higher Level Strategies, Inc., its owners, officers, employees, and contractors from third-party claims, damages, liabilities, or reasonable costs arising from your unlawful use of the Service, your violation of these terms, your infringement of another party's rights, or marketing claims or content created or distributed by you contrary to our policies.
TERMINATION
We may suspend or terminate access to Viral Accelerator when a user materially violates these terms, engages in fraud or abusive activity, attempts to compromise our systems, unlawfully exploits our intellectual property, or uses our services in a manner that creates material legal or security risk.
Termination for a material violation does not automatically create a right to a refund.
CHANGES TO THESE TERMS
We may update these terms as Viral Accelerator evolves or when necessary to reflect operational, technical, or legal changes.
The current version will be published on this page with an updated revision date.
Changes will apply prospectively except where a different treatment is required by law.
GOVERNING LAW
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute concerning these terms or Viral Accelerator will be subject to applicable federal law and the laws of the State of Florida.
